Understanding Your Family-Based Immigration Options

Family-based immigration is one of the most common paths to a green card (technically called lawful permanent residence). It can also pave the way to eventual U.S. citizenship. Immigrating through a family member can be a complicated process, however. There are strict eligibility requirements, potential legal hurdles and, depending on the family relationship, the possibility of a lengthy wait time. Missteps can set you back significantly.

What To Expect With The Family-Based Immigration Process

Family-based immigration is a wide umbrella that covers several different types of immigrant visas. Our attorneys can guide you through any type of family immigration case, including:

There are generally two processes for pursuing a family-based green card:

  • Consular processing involves returning or staying in your home country to pursue a green card through the U.S. Consulate or Embassy.
  • Adjustment of status allows you to remain in the United States while pursuing your green card here.

For people who are already in the United States, with or without a current immigration status, adjustment of status is often preferable. It doesn’t involve travel and allows you to remain here, with your family, for the time it will take for the United States Citizenship and Immigration Service (USCIS) to process your application.
